**CERCLA Landfill Closures

***The ordnance areas, upon transfer of property, will have unrestricted land use;
therefore deed restrictions are not anticipated in the future.

Institutional Controls

a Land Use Restrictions are required to ensure that the land uses are consistent with the
anticipated land use for each site.

b Equitable Servitude may be required for these sites at the time of transfer of the
property. The final equitable servitude language will be provided in the Finding of Suitability to Transfer.

c The Downtown groundwater is restricted for domestic use.

d Excavation permits are required at all sites. Excavation is prohibited at the landfills and sites with a
soil cover.

e Inspection and reporting of institutional controls annually, or as necessary as appropriate.
Assess the need to take additional action or to reduce controls, as appropriate.

Engineering Controls (action responses associated with the implementation of institutional controls)

f Fishing advisory to recommend limiting subsistence consumption of bottom fish and mussels
Annually conduct visual inspection of soil cover and make repairs as necessary.
Ensure that the cover at the site remains intact.
This engineering requirement requires that repairs be made to the covers as necessary.

g Education Program (required for shellfish/fishery advisory and for ordnance hazards).

h Place and annually inspect signage for shellfish fishery advisory and ordnance hazards.

i Annually inspect soil covers to ensure they remain intact.

j All petroleum sites lists, with the exception of the downtown exchange area groundwater site, are covered under the OU A ROD addendum.
